3. Provision of Training Vehicle
Your safety and that of the general public is always a priority and your instructors decision as to your test readiness is final. We reserve the right to withold use of the Training Vehicle for test if it considered that your driving standard could cause a risk to public safety or the Training Vehicle. We accept no liability for any loss arising from any refusal to provide the Training Vehicle in these circumstances.
Where the Training Vehicle is used for test, the booking period will based on your instructors standard diary schedule. This may preclude Saturday and early morning test appointments. Depending on the time of the test, this will require a minimum two hour booking and occaisionally longer.
Whilst your instructor will make every effort to ensure the vehicle supplied for test will be fully roadworthy and comply with all legal requirements at the start of the test, We cannot be held responsible for vehicle failure that occurs during the test nor are we liable for any loss arising out of or in connection with any such failure.
We shall make every effort to ensure the Training Vehicle you are learning in is available for your test. In the event of an accident or mechanical breakdown of the Training Vehicle, we shall endeavour to supply an alternative vehicle, which may be a different make/model; however, this is outside our reasonable control and we cannot be held liable for failure to provide an identical specification vehicle. In the event we are unable to supply an alternative vehicle, our liability is limited to paying for a new test date only.
4. Test Cancellation
PLEASE NOTE: If you need to cancel or re-schedule your test, the DVSA requires at least three (3) clear working days’ notice (Monday to Saturday excluding public holidays in England) or you will forfeit the test fee (see DVSA terms &conditions).
If your test is to be re-scheduled, you must immediately inform your instructor of your availability and agree a mutually convenient date before confirming a test booking.
We cannot be held responsible for any loss of test fees arising from failure by you to give timely correct information with regard to your availability.
We cannot be held responsible for test appointments cancelled by the DVSA due to bad weather, sickness, staff shortages or other reasons beyond our control. Such cancellations are beyond our reasonable control and the lesson fee and ‘use of car’ fee for the booked period will be charged. However, in such circumstances (other than bad weather) you may be able to claim limited compensation from the DVSA (see DVSA website for details)
